TERMS AND CONDITIONS
- Understanding
- The terms and conditions below apply to all services provided by Sabrina Andreucci (Pty) Ltd (“the company”) to any individual or organisation (“the client”) and constitute the contract for the service to be provided by the company for the client.
- “Services” include, but are not limited to, life and business coaching, numerology reading, life and business strategy, Rapid Transformational Therapy® (RTT®), hypnotherapy, Neurolinguistic Programming (NLP), psychic oracle card reading, guided psychic session, online or in-person masterclasses, online or in-person masterminds, retreats, etc.
- “Session” refers to the delivery of the services by the company to the client, via an online conferencing platform.
- These terms are applicable to all sessions offered by the company to the client whether paid for or for free, conducted live or recorded, conducted in person or online, one-on-one or in a group setting.
- The services offered by the company are not psychological counseling or any type of medical or psychological therapy and should not be construed as such.
- The information, techniques, methods, and recommendations provided by the company are not intended as a substitute for the diagnosis and care of a qualified medical practitioner nor to encourage the treatment of illness by persons not recognisably qualified.
- In return for the fees payable by the client (or by a third party on their behalf), the company agrees to provide the service(s) as described and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).
- The company cannot and does not guarantee results since the client’s own personal success depends on many factors that the company has no control over, including the client’s willingness and desire to affect the changes inside of themselves.
- By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
- We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.
- This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only.
- We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
- Confidentiality
- Personal information or business information supplied to the company by the client on application of and during sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law.
- The company will respect the client’s privacy and seek written permission before disclosing they are a client.
- The company does not retain any client cardholder account data. Payments are processed via a secure merchant gateway and the company does not ever access client cardholder account data.
- Pricing and Payments
- Prices for our products and services are subject to change without notice.
- We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
- We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.
- You agree to provide current, complete, and accurate purchase and account information for all purchases made from the company. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
- You are responsible to pay the full amount of the price you originally agreed to pay for any program you purchase, regardless if you leave the program, do not complete it in the time-frame provided, or don’t use the container at all.
- If you were not able to pay in full for a program and require a payment plan, you are still responsible for the full purchase price of the program originally agreed to.
- If payments are late, we reserve the right to remove you from all programs where applicable until payments are again current. We also reserve the right to terminate your agreement, and you will be responsible for paying the difference in the full price for each program that has taken place since you registered.
- Nothing herein shall limit Sabrina Andreucci (Pty) Ltd from seeking payment for any chargeback or credit card disputes made by you at any time. By accepting the terms of this agreement, you agree to never dispute any charges already paid, no matter the payment vehicle. (Example: Paypal, PayFast, bank transfer, etc.)
- Coupons and Discount Codes
- On occasion, the company may offer coupon or discount codes that can be redeemed for services and/or products as stipulated on the coupon or discount code.
- There are two types of Coupons: a Coupon with a fixed amount of a discount, e.g. R100 / $10 off (“Fixed Coupon“), and a Coupon with a percentage discount, e.g. 10% off (“Percentage Coupon“).
- Coupons are issued at the company’s sole discretion, and we are entitled at any time to correct, cancel, or reject a Coupon for any reason (including without limitation where a Coupon has been distributed in an unauthorized manner). Users do not have a right to Coupons, and Coupons cannot be earned. Coupons are issued under specific terms and conditions regulating when and how they may be used.
- As a general rule, and unless specified otherwise on the specific Coupon itself:
- Each Coupon can only be used once;
- Only one Coupon can be used per order;
- Only one Coupon can be used on the website per person per promotion/campaign;
- Coupons with a percentage discount offer may only be used on purchases with a total cart value of less than R5,000 and/or $300;
- A Coupon must be used at check-out – it cannot be used later on existing orders;
- The value of the Coupon will be set off against the subtotal value of your shopping cart and the balance remaining, if any, will be payable by you;
- And the value of the subtotal of your shopping cart must be at a minimum of the value of the Coupon in order to redeem the Coupon.
- Coupons cannot be used to buy Gift Vouchers or other Coupons, and cannot be exchanged or refunded for cash or credit. Sabrina Andreucci (Pty) Ltd is not responsible for any harm due to the loss, unauthorized use, or distribution of a Coupon.
- Cancellation & Rearranging Sessions
- Where a client pays for a session, or sessions, in advance they must have the coaching session(s) that they have paid for within 1 month of the payment, or any untaken sessions are forfeited.
- The client may terminate their coaching contract at any time in writing. No refunds will be due however. Any services that have yet to be provided at the time of cancellation will therefore be deemed as having been provided.
- The company can elect to terminate the service to the client early or refuse to provide any further support services should the company deem the relationship unworkable. Refunds in these extraordinary circumstances will be made at the discretion of the company and are not guaranteed.
- If the client needs to rearrange a session, they should provide a minimum of 24 hours’ notice, or the client will be charged the full price of the session.
- No refunds will be given to clients for unused sessions.
- In exceptional circumstances, the company may need to rearrange a session; in these circumstances, the company will use reasonable endeavors to provide a mutually satisfactory alternative appointment for the client.
- The client acknowledges and agrees that unused sessions cannot be transferred to other parties. This provision is in place to ensure the attendance of sessions for which payment has already been made.
- Refund Policy
- Due to the nature of our services, we do not offer refunds after purchase.
- Intellectual Property
- All services offered by the company contain intellectual property owned by the company.
- No services or sessions, or portion of the services or sessions offered by the company may be copied, duplicated, modified, published, transmitted, transferred, distributed, displayed, reproduced, sold, resold, exploited or performed in any way.
- All materials whether digital or hardcopy provided by the company to the client remain the intellectual property of the company.
- The client agrees to not independently record any portion of the session(s) or service(s) offered by the company. This includes any screenshots/screen captures/screen recording/photocopy/sound recording.
- Electronic Signature
- Signatures transmitted digitally and created electronically via touchscreen or computer mouse shall have the same force and binding effect as an original handwritten signature in ink.
- Testimonials
- By submitting a Testimonial, you agree that the company may use and publish this in any manner that the company may deem appropriate in connection with its use of your Testimonial.
- You agree that you are not entitled to any financial compensation for the use of your Testimonial.
- You agree that the company may use your Testimonial with your name, unless explicitly stated otherwise, or with a fictitious name, or without any name, and may make reasonable edits or alterations to your Testimonial, provided that the meaning of your comments and statements is not substantially changed.
- You hereby waive any right of approval with respect to the use of your Testimonial and any materials created by the company in connection with your Testimonial.
- You understand that the company has no obligation to use your Testimonial and may elect to use or not to use your Testimonial (or any derivative work created from your Testimonial) in the company’s sole discretion.
- You represent and affirm that:
- You, and only you made your Testimonial voluntarily;
- It contains your own opinion;
- It is based on your own experience(s) with the company and the company representatives;
- And it is true and correct to the best of your knowledge.
- You represent and affirm that you will contact the company in writing addressed to Sabrina Andreucci (Pty) Ltd if at any time your opinion about the company or its services, as expressed in your Testimonial, should change and you wish to retract your Testimonial.
- Information you provide in connection with your Testimonial will be stored and used in accordance with the company’s Privacy Policy.
- Waiver
- We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
- We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
- You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
- You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
- In no case shall Sabrina Andreucci (Pty) Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
- Regression Therapy Disclaimer
- Regression therapy is an approach to treatment that focuses on resolving significant past events believed to be interfering with a person’s present mental and emotional wellness. Only people with sound mental health who are confident that a review of past events will not adversely impact their emotional or mental health should participate.
- The company requests that the client does not participate in regression therapy if they or their treating practitioners have any past or existing concerns about their mental health.
- Health Disclaimer
- People with epilepsy or any person diagnosed as having a psychotic illness should not enter hypnosis.
- It is the responsibility of the client to disclose this information and the company accepts no responsibility.
- You understand that Sabrina Andreucci is not a licensed physician, psychologist, or medical practitioner of any kind and that hypnosis or coaching should not be considered a replacement for the advice and/or services, of a psychiatrist, psychologist, psychotherapist, or doctor.
- The information, techniques, methods, and recommendations provided by the company are not intended as a substitute for the diagnosis and care of a qualified medical practitioner nor to encourage the treatment of illness by persons not recognisably qualified.
- If the client uses hypnosis and is under medical care for any condition, they are advised not to make any adjustments to any prescribed medication without the approval of their qualified medical practitioner. If in any doubt, the client should seek medical advice.
- Acceptance of Terms
- By completing a form or making a purchase from us, you acknowledge and agree that you have carefully read and understand these terms and conditions.
